Soul DefendHER™ Terms of Service

Thank you for choosing Soul DefendHER™, co-branded by Soul Punch™ Self-Defense in partnership with Plegium®. Our goal is to provide a powerful, intuitive safety device that integrates seamlessly with the Soul DefendHER™ app to offer personal protection when it matters most. We hope you never need to use it, but if you do, we want you to be equipped.
By using Soul DefendHER™ products or services, you agree to these Terms of Service. If you do not agree, do not use our products or services.
1. Changes to These Terms and the Services
We may update these Terms of Service at any time. If we do, we will revise the “Effective Date” above. Continued use of the services after changes are posted constitutes your acceptance of the revised Terms.
2. Technical Requirements for Use
To use the Soul DefendHER™ app and device:

Your smartphone must have Bluetooth enabled.

Your phone must be within range of the Soul DefendHER™ device.

The Soul DefendHER™ app must be installed and active (even in the background).

Your device must have internet access via Wi-Fi or mobile data.

You must enter at least one emergency contact into the app.
We do not guarantee service functionality outside of supported regions or in case of poor connectivity. The service may not function if any of the above requirements are not met.
3. Your Account(s)
You are responsible for any use of your account. If you suspect unauthorized access, you must notify us immediately. You may only use our services as a private individual, not on behalf of an organization, without written permission.
4. Collection and Use of Customer Data
We collect Customer Data to provide our services. This includes:

Your name, email, and phone number

Emergency contacts entered into the app

Location data when the device is activated

Device and usage logs
We use this data to:

Provide real-time alerts to your emergency contacts

Support customer service and diagnostics

Improve the service and maintain safety
We may disclose your data if:

5. Privacy Policy
Please refer to our full Privacy Policy. Use of our device or app implies acceptance of our Privacy Policy.
6. Restrictions on Use
You may not:

Resell or sublicense the Soul DefendHER™ services or device

Reverse engineer, decompile, or replicate the software or hardware

Use the product for unlawful purposes

Modify or tamper with device firmware or the app
7. Warranties and Disclaimers
Soul Punch™ and Plegium® disclaim all warranties, express or implied. The Soul DefendHER™ device and related services are provided “as-is.” We do not guarantee that every alert or function will operate perfectly under all conditions.
8. Limitation of Liability
To the maximum extent permitted by law, Soul Punch™ and Plegium® shall not be liable for any indirect, special, incidental, or consequential damages. Total liability, if any, shall not exceed the amount paid for the product within the twelve months preceding the incident.
9. Termination
You may terminate your account at any time through your mobile app settings. We may suspend or terminate your access if you breach these Terms or use the service in an abusive or fraudulent manner.
10. General Provisions
Governing Law: These Terms are governed by the laws of the State of New Mexico, USA.
Force Majeure: We are not liable for delays or failure due to causes beyond our control (e.g., natural disasters, outages, government restrictions).
Entire Agreement: These Terms constitute the full agreement between you and Soul Punch™.
Severability: If any part is deemed unenforceable, the remainder remains in effect.
Assignment: You may not assign these Terms without our consent.
